Small Claims Track
Under the small claims track it is possible to make a claim against individuals (and organisations but not local government) for damages, including personal injury up to £10,000. York Human Rights plans to offer members of this site an opportunity to convert a grievance into a claim against a single Councillor up to £1,000. This facility is currently only available to residents of York (ie have a York post code) and have a published grievance.

The process is:

first create a grievance and publish it.

then edit it to add your name, address and email (from your my account information)

after these steps, please change MCOL setting to Yes - This means that you want to make a claim under the small claims track.
This will trigger a request to the York Human Rights team. If the grievance is approved for conversion to a claim, the team will set the MCOL approved setting to Yes. This will enable you to transfer the information from the grievance post to a form which when submitted will send the information to the team for the team to create a claim on the MCOL website.
As the plaintiff, you can cancel the claim at any time. In addition, under the small claims track process you are only responsible for your own legal costs. The defendants legal costs can not be awarded against you.
These claims are handled by Northampton County Court Business Centre, which has a backlog of cases, so it will take time for the legal process to unfold. The next step will be to try to get the case transferred to the York County Court. The plan to ask for mediation where you supported by the York Human Rights legal team, will present the case and ask for the councilor involved to get the City of York council to make restitution for the abuse of your human rights.
